01 Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User") and EraseMe ("Licensor") for the use of EraseMe software ("Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

02 License Grant

Subject to the terms and conditions of this EULA, EraseMe grants you the following non-exclusive, non-transferable license:

• Free License: Install and use the Software on one (1) personal device. Limited to features available in the free tier.
• Pro License: Activate and use the Software on the device ID used during license generation. Includes all Pro features on that licensed device.
• The license is for personal, non-commercial use only unless otherwise agreed in writing.
• Your license is perpetual for the version purchased. Future major versions may require a separate purchase.

03 License Restrictions

You may not:

• Copy, modify, or distribute the Software or any portion thereof.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code.
• Rent, lease, lend, sell, sublicense, or transfer the Software or your license rights.
• Remove or alter any copyright, trademark, or other proprietary notices.
• Use the Software on more devices than your license permits.
• Use the Software to destroy data you are not legally authorized to delete.
• Attempt to defeat, bypass, or circumvent any licensing or anti-piracy mechanisms.

04 Ownership & Intellectual Property

The Software is licensed, not sold. EraseMe retains all right, title, and interest in and to the Software, including all intellectual property rights therein.

You acknowledge that no title to the intellectual property in the Software is transferred to you. You will not acquire any rights to the Software other than those expressly granted in this EULA.

05 Risk, Data Loss & Backups

You expressly acknowledge and agree that:

• You are solely responsible for maintaining adequate backups of all data before using encryption or deletion features.
• Forgotten passwords can result in permanent loss of access to encrypted files. There is no password recovery mechanism, by design.
• EraseMe bears no liability whatsoever for any data destroyed or made inaccessible through use of the Software.
• You have verified that any data you process belongs to you or that you have legal authority to encrypt or delete it.

06 Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ERASEME EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING:

• Implied warranties of merchantability and fitness for a particular purpose.
• Warranties that the Software will meet your requirements or be error-free.
• Warranties of non-infringement of third-party rights.
• Warranties regarding the security, reliability, or availability of the Software.

07 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERASEME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING:

• Loss of data, files, revenue, profits, or business.
• Cost of substitute goods or services.
• Personal injury or property damage resulting from use of the Software.
• Unauthorized access to or use of your data.

EraseMe's maximum aggregate liability arising from this EULA shall not exceed the amount you paid for the Software license.

08 Refund Policy

Due to the digital nature of the Software, all sales are generally final. However, we offer refunds in the following circumstances:

• The Software fails to install or run on a supported operating system despite reasonable troubleshooting.
• A refund request is made within 14 days of purchase and the license has not been used in a way that conflicts with the device-bound license terms.
• The Software is materially misrepresented in its marketing.

09 Updates & New Versions

EraseMe may provide updates, bug fixes, or patches for the purchased version at its discretion, at no additional cost.

Major new versions (e.g., EraseMe 2.0) may be offered as a separate paid upgrade. You will always be entitled to continue using the version you purchased.

Updates may modify or remove features. EraseMe is not obligated to maintain any specific feature set across versions.

10 Termination

This EULA is effective until terminated. It will terminate automatically if you breach any of its terms.

Upon termination, you must immediately cease all use of the Software, uninstall it from all devices, and destroy all copies in your possession or control.

Sections relating to ownership, disclaimer of warranties, limitation of liability, and governing law shall survive termination.

11 Governing Law

This EULA shall be governed by and construed in accordance with applicable law. Any disputes arising from this agreement shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

If any provision of this EULA is found to be unenforceable, the remaining provisions will continue in full force and effect.
